Instagram Contest Rules

1. THERE IS NO PURCHASE OR PAYMENT OF ANY KIND NECESSARY TO ENTER OR WIN THIS CONTEST.
2. Age Limit. You must be at least 18 years of age to participate in our Instagram (“IG”) online Contest.
3. Eligible Participants. This Contest is open to the public with a USA-based public profile IG account, with the exception of employees of Adsmovil USA, Inc, (“Adsmovil”) participating sponsors, immediate family members of the aforementioned and/or persons residing in their household(s).
4. The Contest Process and Entry Period. The Contest will consist of each contestant posting a photo of their 2022 holiday celebration (food and/or decorations) with a tag to @NuestraTVforUS in their IG account (the “Photo”). You may enter only once during the Contest period. The Contest will run from December 9, 2022, through January 6, 2023 (4 weeks). The weekly winner will be the person (not a Bot) who has accumulated the most “likes” on their posted holiday photo tagging @NuestraTVforUS. tagging @NuestraTVforUS.  We will announce a winner each Friday at noon PST/3:00 EST, starting 12/16/2022. Entries must be in by 6:00 PST/9:00 EST on every Thursday of the contest, starting 12/15/2022.
5. Prize. The Weekly Prize will be a Giftcard with a value of $125. Prizes are non-transferable.
6. Tiebreaker. In the event of a tie in the number of likes of weekly photos, the Adsmovil contest judge will decide on the winner based on the criteria of creativity of the photos in question weighted 60% on creativity and 40% on the number of likes. The judge’s decision will be final.
7. Changes. Adsmovil may amend or change these rules without prior notice.
8. Taxes. All state local and federal taxes are the sole responsibility of the winner(s).
9. Right of Disclosure/Publicity. Entry into the Contest constitutes permission to use each entrant’s Photo, name, and image in publicity and for marketing purposes, including allowing Adsmovil to refer to an entrant’s survey responses if any, and/or in conjunction with announcing any winner, if applicable. Specifically, entrants agree Adsmovil may use the entrant’s name, IG account, photograph, image, voice and/or likeness, and statements or survey responses for any advertising and promotion purposes without any compensation.
10. Limitation of Liability, etc. Adsmovil is not responsible for incomplete entries or for failure to receive entries due to transmission or technical failures of any kind including but not limited to malfunction of any network, hardware, or software, whether originating with the sender, any third party or with Adsmovil or for any human error, lost or delayed data transmission where entry is electronic. By participating in the Contest the winner agrees that Adsmovil will have no responsibility whatsoever for losses or damage of any kind resulting or arising from the acceptance, possession, or use of the prize and further agrees to release and hold harmless Adsmovil, its agents and representatives, from any losses, damages, claims, and/or liabilities arising in connection therewith. Except where prohibited, participation in the Contest constitutes entrant’s consent to the publication of his or her name, survey responses and comments in any media for commercial or promotional purposes without limitation or further compensation. Without limiting the foregoing, in no case will the liability of Adsmovil or any of its related or affiliated companies exceed the amount of the $125 prize of this contest.
11. Data Ownership. All information & data acquired during the Contest will become the sole property of Adsmovil and will either be destroyed or securely stored through our facilities pursuant to our Privacy Policy.
12. Winners List: For a list of the winners, send a self-addressed stamped envelope with your written request for the list of winners to: Nuestra.TVforUS Contest, c/o Adsmovil USA, Inc. d/b/a NuestraTV, 222 Ponce De Leon Blvd, Suite 6-112, Miami, Florida 33134 USA – ATTN: Marketing Department. Requests must be received by January 10, 2023.
13. Violation. Violation of any of the official rules will result in immediate forfeiture of all prizes and may result in a permanent ban on participating in any future promotional events by Adsmovil and/or its participating affiliated companies and sponsors.
14. Adsmovil Modification/Cancellation Rights. Adsmovil reserves the right to cancel, suspend, modify or terminate the Contest at any time in the event of any technical malfunction or any unauthorized 3^rd party tampering which corrupts the administration, security, or proper play of the Contest. In its sole discretion, Adsmovil may disqualify from the Contest any person it determines, in its sole discretion, to have attempted to or actually tampered with or otherwise abused any aspect of the Contest.
15. Choice of Law and Venue. All Contest Winners agree that any disputes that may arise in connection with this Contest will be governed by, and will be construed under, the laws of the State of Delaware, without giving effect to its conflict of law provisions and will be subject to the exclusive jurisdiction of the state and federal courts located within New Castle County, Delaware and all winners agree to submit to the personal jurisdiction and venue of such courts and not to seek the transfer of any action or proceeding out of such courts.
16. Contest Not Affiliated with Instagram. This Contest is not sponsored, endorsed, administered or affiliated with Instagram in any way.  In entering this Contest, you agree to Instagram’s Terms & Conditions and Privacy Policy and release Instagram of any and all liability in connection with the Contest.
